Licence terms

These terms are between you and Tunes of Fantasy GmbH, Häberlinstrasse 65, 8500 Frauenfeld, Switzerland, trading as Titanscore Audio. They apply to Ostinato, Piano and every other instrument sold on titanscoreaudio.com.

Our order process is conducted by our online reseller Paddle.com. Paddle is the merchant of record for all orders: it sells the licence to you, takes the payment, issues the invoice, handles VAT and sales tax, and answers billing questions. Paddle's buyer terms apply to the purchase itself. The licence is granted by Tunes of Fantasy GmbH under the terms on this page.

Refunds are covered by the refund policy.

Buying an instrument gives you a non-exclusive, perpetual licence to install and use it on up to two machines you own or control. You can move a licence to another machine at any time by releasing the old machine in your account.

The licence covers all point releases of the version you bought. A future major version may be a separate purchase.

You may use anything the plugin writes, every MIDI file you drag out, in commercial releases, film, games and advertising, with no royalty and no credit required. This right is non-exclusive: other customers can produce the same or a similar pattern, and nobody can claim a pattern the plugin produced as their own. What you make with it is yours.

The MIDI the plugin writes may be used only as part of your own music. You may not sell, share or give away the patterns themselves, as MIDI files, loops, presets, packs, templates or in any other form that lets someone use them without a licence of their own, and you may not use them to build a competing product or a library of any kind.

This applies just as much to patterns you have edited, changed or saved as your own presets. Moving, adding or deleting notes does not make a pattern yours to sell or pass on: everything the plugin produces, edited or not, remains the property of Titanscore Audio, and your right is to use it in your music.

The instruments, their presets and the pattern library remain the property of Titanscore Audio. You may not copy, share, resell, rent out or redistribute the plugin, its installer or any part of it, nor share your licence key or activation with anyone, nor bypass, remove or tamper with the activation, nor decompile, reverse engineer or extract the presets or the pattern library from it. Copyright notices, licence keys and other identifying features may not be removed or altered.

You may not use the plugins, their presets, the pattern library or anything they produce for text and data mining, or to train, test or improve any software or system that generates music, audio or MIDI. Tunes of Fantasy GmbH expressly reserves these uses.

Ostinato, Piano, their code, presets, pattern library, names and artwork are copyrighted works of Titanscore Audio. The licence lets you use them; it transfers nothing. Any use not expressly allowed here is not allowed.

The instruments are provided as they are. We do not promise that they run without interruption or error on every system, or that a pattern suits a particular purpose. Please check the system requirements before buying.

We are liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health. In all other cases, and to the extent the law allows, we are not liable for indirect damage, lost profit or lost data, and our liability is limited to the price you paid for the licence.

If you are a consumer, the statutory warranty rights that cannot be excluded under the law of your country of residence remain unaffected.

If you breach these terms, in particular by sharing the plugin or a key, by bypassing the activation or by passing on the patterns, the licence ends and the activation can be revoked without refund.

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is Frauenfeld, Switzerland. If you are a consumer, the mandatory consumer protection law of your country of residence and your right to bring proceedings there remain unaffected.

If any provision of these terms is or becomes invalid, the remaining provisions stay in force. The invalid provision is replaced by a valid one that comes as close as possible to its purpose.

These terms are written in English, and the English text is the only binding version.
